We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date above. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By creating an account, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. User Accounts

To submit a listing or access certain features, you must create an account. You are responsible for:

  • Providing accurate, current, and complete registration information.
  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.

You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.

4. Listings and User Content

By submitting a startup listing or any other content ("User Content") to the Service, you represent and warrant that:

  • You own or have the right to submit the content.
  • The content is accurate and not misleading.
  • The content does not infringe any third-party rights, including intellectual property rights.
  • The content does not violate any applicable laws or regulations.
  • The product or service described is legitimate and operational (or clearly marked as a pre-launch).

We reserve the right to review, edit, or remove any listing or User Content at our sole discretion, including but not limited to content that is fraudulent, misleading, offensive, spam, or otherwise violates these Terms.

5. Prohibited Conduct

You agree not to:

  • Submit false, misleading, or deceptive listings.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Use the Service to distribute malware, phishing schemes, or other harmful content.
  • Attempt to manipulate upvotes, reviews, or rankings through fake accounts, bots, or coordinated activity.
  • Scrape, crawl, or harvest data from the Service beyond what is permitted by our robots.txt.
  • Interfere with or disrupt the Service, servers, or networks.
  • Use the Service for any illegal purpose.
  • Create multiple accounts to circumvent restrictions, bans, or usage limits.
  • Post content that is defamatory, obscene, hateful, or incites violence.

6. Payments and Pricing

Certain features of the Service require a one-time payment or subscription ("Paid Features"). All payments are processed securely through Stripe. By purchasing a Paid Feature, you agree that:

  • All pricing is displayed in US Dollars (USD) unless otherwise stated.
  • Prices are subject to change. We will honour the price displayed at the time of your purchase.
  • You are responsible for any applicable taxes.
  • Payment information is handled directly by Stripe. We do not store your credit card details.

7. Refund Policy

All purchases on Sell With boost are for digital services delivered immediately upon payment. All sales are final and non-refundable unless an exception applies. By completing a purchase, you acknowledge immediate delivery and waive any applicable cooling-off period to the maximum extent permitted by law.

8. Featured Placement and Subscriptions

Featured placement is time-limited and begins as soon as your listing is approved (for paid tiers, this is typically instant). The duration depends on the plan you purchase.

Monthly subscriptions renew automatically. You may cancel at any time through your Stripe billing portal. Cancellation takes effect at the end of the current billing period — no partial refunds are provided for the remaining days of an active period.

9. Free Listings and Badge Requirement

Free listings may require you to place a Sell With boost badge on your website. We may periodically verify badge placement. If the badge is removed or not found, we reserve the right to delist, unpublish, or downgrade your listing.

10. Intellectual Property

Your Content: You retain full ownership of the content you submit. By submitting content, you grant Sell With boost a worldwide, non-exclusive, royalty-free licence to display, distribute, and promote your content in connection with the Service, including in newsletters, social media, and marketing materials.

Our Content: The Service, including its design, branding, code, and features, is owned by Sell With boost and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

DMCA: If you believe content on the Service infringes your copyright, contact us at [email protected] with a description of the alleged infringement. We will respond in accordance with applicable copyright law.

11. Reviews and Community Features

Users may post reviews, upvotes, and other community interactions. You agree that your reviews will be honest and based on genuine experience. We reserve the right to remove reviews that are fake, defamatory, or that violate these Terms.

Listing owners may reply to reviews. Replies must remain professional and on-topic.

12. Third-Party Links

The Service may contain links to third-party websites, products, or services. We are not responsible for the content, accuracy, or practices of any third-party sites and do not endorse them. Accessing third-party links is at your own risk.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • Any specific amount of traffic, exposure, or business results will be achieved from a listing.
  • User Content or listings are accurate, complete, or reliable.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Sell With boost, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

15. Indemnification

You agree to indemnify, defend, and hold harmless Sell With boost and its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to use the Service ceases immediately.
  • We may remove your listings and User Content.
  • Provisions of these Terms that by their nature should survive termination will remain in effect (including Sections 10, 13, 14, 15, and 18).

You may delete your account at any time by contacting us. Account deletion requests will be processed within a reasonable timeframe.

17. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Sell With boost operates, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

18. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Sell With boost regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights at any time.
